1. Introduction

Welcome to RaceToConnect.

These Terms of Service ("Terms") govern your access to and use of the RaceToConnect mobile applications, website, software, connected hardware services, GPS tracking, vehicle telemetry, race analytics, video streaming and related services (collectively, the "Services").

By creating an account, purchasing a subscription, or using our Services, you agree to these Terms.

If you do not agree, you must not use the Services.

Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer protection laws.

2. Description of Services

RaceToConnect provides technology for motorsport enthusiasts, drivers, racing teams, engineers and spectators.

Depending on your subscription, compatible hardware and available functionality, our Services may include:

Real-time GPS vehicle tracking.
OBD/CAN vehicle telemetry.
Engine RPM, speed and vehicle sensor monitoring.
Lap timing and sector analysis.
Race history and performance analytics.
Live race dashboards.
Video recording and livestreaming.
Integration with YouTube and other third-party streaming services.
Team management and vehicle profiles.
Subscription-based features.
Public race broadcasts and sponsor advertising.

Certain features require compatible devices, an internet connection, supported vehicle systems or additional subscriptions.

We may update, improve or modify features as our platform develops, subject to applicable law and our contractual obligations.

3. Eligibility and Account Registration

To use certain features, you must create a RaceToConnect account.

You agree to:

Provide accurate account information.
Keep your login credentials confidential.
Maintain the security of your account.
Notify us promptly of suspected unauthorized access.
Use the Services only for lawful purposes.

You are responsible for activities conducted through your account, except where those activities result from circumstances for which we are legally responsible.

Users under the age of 18 must have permission from a parent or legal guardian where required by applicable law.

We may suspend accounts involved in fraud, abuse, security violations or serious breaches of these Terms.

4. Motorsport Safety and Driver Responsibility

RaceToConnect is a motorsport information and telemetry platform. It is not a vehicle safety system.

Motorsport involves inherent risks, including serious injury, death and property damage.

Users acknowledge that:

Motorsport activities may be dangerous.
Telemetry and GPS information may be delayed or inaccurate.
Electronic devices may experience interruptions or failures.
RaceToConnect does not replace professional race equipment, safety procedures or official race control.
Drivers remain responsible for operating their vehicles safely.
Applicable racing regulations, circuit rules and safety instructions must always be followed.

Drivers must not operate, configure or interact with the RaceToConnect application while driving if doing so could cause distraction or violate applicable laws or racing regulations.

Where appropriate, the application should be configured before driving or operated by a passenger, engineer or authorized team member.

RaceToConnect must not be relied upon as the sole source of information for safety-critical decisions.

5. GPS Tracking and Location Accuracy

RaceToConnect may use GPS information from smartphones, external tracking devices or compatible vehicle hardware.

GPS accuracy depends on several factors, including:

Satellite reception.
Device hardware.
Environmental conditions.
Signal interference.
Data transmission delays.
Internet connectivity.
GPS update frequency.

We do not guarantee uninterrupted tracking, exact positioning or a particular level of GPS accuracy.

GPS-based lap times and sector times are informational unless expressly certified or approved for official timing purposes.

RaceToConnect is not an official motorsport timing authority.

Users should not rely exclusively on RaceToConnect for official race classification, regulatory compliance or safety-critical navigation.

6. Vehicle Telemetry and Connected Hardware

RaceToConnect may connect to compatible OBD, CAN-bus and GPS devices, including Freematics-based hardware.

Vehicle compatibility varies by manufacturer, model, ECU configuration, available sensors and installation.

Not all telemetry parameters are supported by every vehicle.

Users are responsible for ensuring that connected hardware is installed correctly and safely.

Installation must not interfere with:

Vehicle steering.
Braking systems.
Engine control.
Safety equipment.
Electrical systems.
Driver visibility or movement.

We recommend installation by a qualified technician when appropriate.

RaceToConnect does not guarantee compatibility with every vehicle or racing configuration.

Hardware defects, warranties, returns and statutory consumer rights are governed by applicable law and any relevant sales conditions.

Nothing in these Terms excludes mandatory statutory warranty or conformity rights.

7. Lap Timing and Race Analytics

RaceToConnect may calculate lap times, sector times, vehicle performance and other race statistics using GPS, telemetry and software algorithms.

Results may differ from official timing systems because of differences in:

GPS precision.
Timing synchronization.
Data sampling frequency.
Track configuration.
Start and finish detection.
Device processing delays.

RaceToConnect does not guarantee that its calculations will match official race timing equipment.

Analytics, performance predictions and recommendations are provided for informational purposes.

8. Video Recording and Livestreaming

RaceToConnect may allow users to record or broadcast video and audio from their vehicles or mobile devices.

Users are responsible for ensuring that they have the necessary rights, permissions and authorizations to record and distribute their content.

This includes compliance with:

Circuit and event regulations.
Broadcasting and media rights.
Copyright laws.
Privacy and data protection laws.
Applicable image and audio recording rules.
Third-party platform requirements.

Users must not broadcast content that is unlawful, infringes intellectual property rights, violates privacy rights or otherwise breaches these Terms.

We may remove or restrict access to content where reasonably necessary to address legal violations, rights complaints or platform security concerns.

9. YouTube and Third-Party Streaming Platforms

RaceToConnect may integrate with YouTube or other third-party platforms.

When using such integrations, users must also comply with the applicable third-party terms and policies.

YouTube is a service provided by Google.

RaceToConnect is not affiliated with, endorsed by or sponsored by YouTube or Google.

We do not guarantee the availability of third-party streaming services, continued API access, monetization eligibility or advertising revenue.

Third-party providers may change their services, policies, pricing or technical requirements independently.

10. User Content and Intellectual Property

Users retain ownership of the original content they create and upload, subject to the rights of other parties.

By uploading, transmitting or publishing content through RaceToConnect, you grant Fleetconnect B.V. a non-exclusive, worldwide, royalty-free license to host, process, transmit, display and distribute that content to the extent necessary to provide the features you have selected.

This license includes technical processing required for video streaming, telemetry overlays, synchronization and authorized sharing.

The license does not authorize RaceToConnect to sell your original recordings to unrelated third parties for independent commercial exploitation without an additional lawful basis or agreement.

The license ends when the relevant content is deleted or your account is closed, except where continued processing is reasonably necessary for lawful retention, existing authorized distribution or other legal obligations.

Users must ensure they have the necessary rights to grant this license.

11. Public Broadcasts, Sponsorship and Advertising

RaceToConnect may display advertisements, sponsor logos and promotional material within the Services.

Advertisements may appear:

On the RaceToConnect website.
Within the mobile application.
During livestreams.
Alongside race telemetry.
On public race dashboards.

Advertising may be managed by RaceToConnect or authorized advertising partners.

Users are not automatically entitled to advertising revenue generated by RaceToConnect unless a separate written agreement or applicable program expressly provides otherwise.

RaceToConnect may offer optional revenue-sharing or sponsorship programs under separate conditions.

Where users independently control broadcasting rights, RaceToConnect will not acquire ownership of those rights merely through use of the Services.

12. Subscriptions and Payments

Certain RaceToConnect features may require a paid subscription.

Subscription plans, prices, billing periods and included features are displayed before purchase.

By purchasing a subscription, you authorize the applicable payment provider to process the relevant charges.

Unless otherwise stated at purchase:

Subscriptions may renew automatically.
Renewal terms and prices are disclosed before purchase.
Users may cancel future renewals through the applicable account or payment platform.
Cancellation normally takes effect at the end of the paid billing period.
Access to paid features may end when the subscription expires.

Where purchases are processed through Apple App Store or Google Play, their applicable billing and cancellation mechanisms may apply.

Refunds, withdrawal rights and cancellation rights are governed by applicable consumer protection laws and the terms disclosed during checkout.

Mandatory consumer rights remain unaffected.

We will provide legally required advance notice of material price or contractual changes.

13. Free Services and Trial Periods

RaceToConnect may offer free accounts, promotional access or trial subscriptions.

Free and trial features may have limitations concerning functionality, storage, data usage, streaming or historical access.

Any trial that automatically converts into a paid subscription will disclose the applicable terms and charges before the user agrees.

14. Acceptable Use

Users must not:

Use the Services for unlawful activities.
Attempt unauthorized access to systems or accounts.
Interfere with RaceToConnect infrastructure.
Upload malicious software.
Misrepresent their identity or authorization.
Broadcast content without necessary rights.
Harass or threaten other users.
Circumvent subscription or access controls.
Use the Services to unlawfully monitor or track individuals.
Deliberately manipulate race data to deceive other users.
Redistribute proprietary software or platform content without authorization.

We may investigate suspected violations and take proportionate action, including warnings, content removal or account suspension.

15. Availability and Service Interruptions

RaceToConnect aims to provide reliable services but does not guarantee uninterrupted availability.

Service interruptions may occur because of:

Maintenance.
Network failures.
Mobile coverage limitations.
Hardware malfunction.
Cloud infrastructure issues.
Third-party outages.
Software updates.
Events outside our reasonable control.

We may perform maintenance and implement security updates.

Where reasonably possible, we will provide notice of significant planned interruptions.

Any specific service availability commitments must be agreed separately in writing.

16. Data Usage and Mobile Connectivity

RaceToConnect may transmit GPS, telemetry, video and audio data over mobile networks.

Livestreaming can consume significant amounts of mobile data.

Users are responsible for charges imposed by their mobile network providers, except where expressly included in a RaceToConnect subscription or hardware package.

Streaming quality depends on available bandwidth, network conditions and device performance.

We do not guarantee continuous video transmission or uninterrupted mobile coverage.

17. Privacy and Personal Data

Fleetconnect B.V. processes personal data in accordance with applicable data protection laws.

Our Privacy Policy explains the categories of personal data collected, purposes of processing, legal grounds, sharing, retention and user rights.

The Privacy Policy is available at https://racetoconnect.com/privacy.

By using the Services, users acknowledge that their personal data will be processed as described in the Privacy Policy.

Where legally required, separate consent will be requested.

18. Account Suspension and Termination

Users may stop using RaceToConnect and request account deletion.

We may suspend or terminate access where reasonably necessary because of:

Serious or repeated violations of these Terms.
Fraudulent activity.
Security threats.
Unlawful content.
Unauthorized system access.
Non-payment of applicable subscription fees.

Where appropriate, users will be informed of the reason and given an opportunity to resolve the issue.

Termination does not remove statutory rights or obligations that survive termination.

19. Disclaimers and Limitations of Liability

RaceToConnect provides GPS tracking, telemetry, analytics and streaming technology.

To the extent permitted by applicable law, we do not guarantee that the Services will be uninterrupted, error-free or suitable for safety-critical purposes.

Fleetconnect B.V. is not responsible for inaccuracies or interruptions caused solely by external factors outside its reasonable control, except where liability cannot legally be excluded.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or other legally protected claims.

For business users, additional liability limitations may apply under a separately agreed business contract.

These Terms do not limit mandatory consumer rights.

20. Intellectual Property of RaceToConnect

The RaceToConnect name, logos, software, interfaces, designs, documentation and proprietary technology are owned by Fleetconnect B.V. or its licensors.

Users receive a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

No ownership rights in RaceToConnect software or intellectual property are transferred to users.

21. Changes to the Services and Terms

We may update these Terms to reflect changes in legislation, security requirements, technology or our Services.

When changes materially affect users' contractual rights or obligations, we will provide appropriate advance notice and any options required by applicable law.

22. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands.

For consumers residing outside the Netherlands, this choice of law does not deprive them of mandatory protections provided by the laws of their country of habitual residence where applicable.

Disputes will be submitted to a court with jurisdiction under applicable law.

Nothing in these Terms restricts a consumer's mandatory right to bring proceedings before a competent court.
